Acceptance of Terms

By accessing or using ExoVault ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. The Service is operated by ExoVault ("we", "us", "our").

Description of Service

ExoVault provides encrypted, durable memory storage for AI agents. The Service includes a web dashboard, API endpoints, an MCP server, and related tools for storing, searching, and managing encrypted memories, notes, and media.

Accounts

• Valid emailYou must provide a valid email address to create an account.
• CredentialsYou are responsible for maintaining the security of your account and encryption passphrase.
• AgeYou must be at least 16 years old to use the Service.
• One accountOne person or entity may not maintain more than one account.
• ResponsibilityYou are responsible for all activity that occurs under your account.

Encryption and Data Responsibility

ExoVault uses end-to-end encryption. Your encryption passphrase is the sole means of accessing your encrypted data. We cannot recover your data if you lose your passphrase. You are solely responsible for maintaining your recovery phrase in a safe location.

Subscription and Billing

• PlansThe Service offers free trials and paid subscription plans (Starter, Pro).
• TrialFree trials are limited to 14 days with restricted features.
• BillingPaid plans are billed monthly or annually via Stripe.
• OveragePro plans may incur overage charges for usage exceeding plan limits.
• CancellationYou may cancel at any time. Access continues until the end of the billing period.
• RefundsRefunds are not provided for partial billing periods.

Usage Limits

Each plan has limits on memory writes, media uploads, storage, total memories, vaults, and agent connections. Exceeding limits on Trial and Starter plans will block further operations until the next billing cycle. Pro plans allow overage at published rates.

Acceptable Use

You agree not to use the Service for any unlawful purpose; attempt to circumvent usage limits or billing; interfere with or disrupt infrastructure; reverse engineer any part of the Service; store or transmit malware; or resell the Service without written permission.

Intellectual Property

You retain all rights to the content you store in ExoVault. We claim no ownership over your encrypted data. The ExoVault name, logo, and Service code are our intellectual property.

Service Availability

We strive for high availability but do not guarantee uninterrupted access. We may perform maintenance with reasonable notice and are not liable for downtime caused by factors beyond our control.

Termination

We may suspend or terminate your account if you violate these Terms. You may delete your account at any time. Upon termination, your encrypted data will be permanently deleted within 30 days, with backups purged within 90 days.

Limitation of Liability

To the maximum extent permitted by law, ExoVault shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, arising from your use of the Service. Because your data is end-to-end encrypted and we cannot access it, we cannot be held responsible for the content stored within the Service.

Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Governing Law

These Terms are governed by the laws of the European Union and the Republic of Poland. Any disputes shall be resolved in the courts of Poland.

Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or a prominent notice on the Service at least 30 days before they take effect. Continued use of the Service after changes constitutes acceptance.
